Sony attempts to intimidate me over BSB complaint about Primal Scream royalty claims.

This article is in the public interest, and I invite anyone at Sony or the BSB to sue me if they don’t like it. I will not be intimidated because I asked for my rightful royalties and complained about Sonys failure to adhere to disability law.

Sony’s barrister has over the last week and a half been sending me communications that seem to imply that i should pay costs for an “action” resulting from an equality complaint to the BSB!!! He has suggested i pay his costs, just for making the complaint. He also knows I am homeless and vulnerable. This has caused distress as i am sure it was supposed to, when asking for clarity on it, no clarity was received. They have done well and i feel down now because of their failure to communicate.

I spoke to the BSB about this and they have no idea what he is talking about. He has so far sent me more than 3 messages about it, he also previously complained to my advocate about it. Because of this Sony must provide someone who knows what equality law is and I will make the complaint public. It is in the public interest because it is relating to a historical well-known recording that I made, which Sony claim I only “performed” on. This is a total lie.

Sonys disability failures and threats about the BSB:

“I am no expert but I do not think the Equality Act  applies  in any event to this matter  as you are not an employee . Notwithstanding that I have tried to make adjustments  and I appreciate you disagree with my efforts  but any adjustment is by law limited to what is reasonable and therefore proportionate in the circumstances . In my opinion it is not reasonable or proportionate  to expect answers to emails in the number, format and timeline you unilaterally demand . ” how is it possible a barrister who works for Sony does not know what the equality act is ?????

these threats caused distress and there is no doubt in my mind that they were intended as such.

“IF THE ACTION PROCEEDS I WILL HAVE TO INSTRUCT LAWERYS TO REPRESENT ME AS ALTHOUGH I AM CONFIDENT ANY HEARING WILL GO IN MY FAVOUR THERE IS TOO MUCH AT RISK FOR ME TO REPRESENT MYSELF . BY WAY OF EXAMPLE A DECISION WHICH GOES AGAINST ME COULD LEAD TO A SUSPENSION OR BEING DISBARRED AND/OR FINED ANY OF WHICH WILL PROBABLY LEAD TO MY DISMISSAL AS AN EMPLOYEE. IF I INCUR COSTS AND SUCCEED THEN I WILL ASK THE TRIBUNAL FOR THOSE COSTS TO BE REIMBURSED -IT WILL BE UP TO THE TRIBUNAL AS TO WHO SHOULD PAY IF THEY AWARD COSTS.”

“”THE ACTION” IS YOUR REFERRAL TO THE BAR COUNCIL -THIS MAY LEAD TO A DISCIPLINARY HEARING AT WHICH FOR THE REASONS I HAVE SAID I WILL NEED TO BE REPRESENTED BY A LAWYER -THAT WILL COST -IT IS UP TO THE COUNCIL WHETHER TO AWARD THOSE COSTS AND AGAINST WHOM”

these are several of the inappropriate messages Sony sent to me, more to come.

Sonys actions so far:

  • failed to register the track correctly. failed due diligence on examining the contract in 1992. failed again when taking over in 1999. Failed to fix the track in 2015, couldnt find the contract. Ignored what I said, Primal Scream also ignored and then disrespected me, suggesting i didn’t play the guitar, bass and synths. they have since publicly claimed they played my guitar, even so far as to quote the wrong guitar and amp model. My guitar was done on my telecaster which was not for posers like Bobby Gillespie and Innes, it was mud brown. I cried and hugged the guitar when i had to sell it for rent.
  • Since at least 2015 if not 1992, Sony have known and have benefited from a fraudulent contract supplied by Creation records and its cocaine abusing staff. This is participating in fraud.
  • They claim they “own” my work and that there is nothing wrong with the contracts and they are still active. I did not sell my work to sony at all.
  • Their barrister suggested the equality act was only for people who are employed. (!?)
  • He asked my disability communication needs advocate to rewrite what he said, in case any of it is offensive. *facepalm you are supposed to not be offensive in the first place!
  • Sony completely denied i did anything on the track – calling it “performance on the recordings” but failing to indicate whose material i was performing and on what recording. Since the recording was made by me (doh) this does not make sense. They refuse to show me on what basis they claim this or the report they paid to have done, which they did while pretending they were not getting my communications.
  • They have obfuscated communications by splitting the publishing and recording into two companies with both claiming no knowledge of the other, despite being in the same building. all adjustments about that have been refused since June.
  • While Sony deny i did anything, the former label boss and the band vocalist claim it was a “collaboration” with me, and that i added the “chorus” in their respective books.
  • Since June they have been obfuscating communications and emailing back and forth about basically nothing. i assume so i give up.
  • Sony have constantly belittled and disrespected me through this process and I hope the leader of their company sees this. They have no idea of the sheer grit required to go through this. its only because this is probably the last act of my life i am pursuing it (i.e. i cannot make music while doing this and it will take years, by that time i will no longer want to do any music or be dead anyway). They keep commenting that because I have been unable to take this to court before that I am basically “too late”, suggesting its not important and nobody who works there remembers it, while also releasing it over and over again in anniversary sets. these comments are designed to belittle and frustrate me and show no respect for the artist.

There are so far four infringing tracks ive found, all exactly the same thing. people asking me to do musical work and then adding their names to my publishing rights and removing me entirely has been my experience of practically every track ive ever released. So far Sony are responsible for four tracks in my catalogue:

“Higher than the sun” – primal scream

“Shine like stars” – primal scream

“Crapage” – Front 242

“Rhythm of Time” Front 242
